This Privacy Policy pertains to information that is collected on the websites (“Sites”) operated by Elbert Guillory’s America (“ENTITY,” “we”, “our,” or “us”) and that link to this policy. ENTITY is a 527 political organization. ENTITY firmly believes in protecting the privacy of our members as well as visitors to our Sites. BY USING THESE SITES, YOU CONSENT TO THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY AND TO OUR PROCESSING OF INFORMATION FOR THE PURPOSES STATED BELOW. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY, PLEASE DO NOT USE THE SITES.

Please note the arbitration provision set forth below, requiring you to arbitrate any claims you may have against ENTITY on an individual basis. ARBITRATION ON AN INDIVIDUAL BASIS MEANS THAT YOU WILL NOT HAVE, AND YOU WAIVE, THE RIGHT FOR A JUDGE OR JURY TO DECIDE YOUR CLAIMS, AND THAT YOU MAY NOT PROCEED IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE CAPACITY.

Collection, Use, and Sharing of Information

We collect the following types of information from visitors to the Sites: (1) Personally Identifiable Information, (2) Non-Personally Identifiable Information, and (3) passively collected information such as cookies and other technical information.

(1) Personally Identifiable Information

“Personally Identifiable Information” is information that can identify you personally, such as your name, address, telephone number, or email address. We may collect and store the Personally Identifiable Information that you have voluntarily provided to us, that we receive while you are visiting or interacting with the Sites, or from other sources including third-party information providers and third-party platforms. We will share your Personally Identifiable Information with third parties only in the ways that are described in this Privacy Policy.

Personally Identifiable Information is occasionally shared as part of list rentals and exchanges with affiliated and unaffiliated organizations. ENTITY has, and will continue to honor, all requests from individuals that do not want their names and addresses exchanged or shared to any other entity. To request that your Personally Identifiable
Information is not shared as part of these list exchanges, please email EGAprivacy@gmail.com.

We may also provide your Personally Identifiable Information to companies that provide services to help us with our activities, such as offering technical services for our website or managing our database. These companies are authorized to use your Personally Identifiable Information only as necessary to provide these services to us.

We may also use and disclose your Personally Identifiable Information:

 to send our newsletter to you if you choose to subscribe to our newsletter(s),
 to measure and improve the services and features of our Sites,
 as required by law, such as to comply with a subpoena, or similar legal process,
 when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request,
 if ENTITY is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Sites of any change in ownership or uses of your Personally Identifiable Information, as well as any choices you may have regarding your Personally Identifiable Information,
 to any other third party with your prior consent to do so, and
 in any other manner as described at the time of collection.

(2) Non-Personally Identifiable Information

“Non-Personally Identifiable Information” is information that does not identify you personally. It can include technical information or demographic information, such as your age, gender, interests or zip code. Please note that we consider aggregated information, which is not personally identifiable, to be Non-Personally Identifiable
Information. We may also tie Non-Personally Identifiable Information with Personally Identifiable Information in order to ensure that the Sites and our services meet your needs. When we tie Non-Personally Identifiable Information with Personally Identifiable Information, it is considered “Personally Identifiable Information” for the purposes of this Privacy Policy. That means that we will be using and sharing this combined data in the ways described in that section above.

We may combine this automatically collected log information with other information we collect about you. We do this to improve services we offer you, to improve marketing, analytics, or site functionality.

The above provides examples of the Non-Personally Identifiable Information that is collected via the Sites, but is not meant to be an exhaustive list. Non-Personally Identifiable Information is used as described above and in other ways as permitted by applicable laws.

(3) Cookies and Technical Information

As is true of most websites, we gather certain information automatically and store it in log files. This information may include your IP addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. When this information can identify you personally, we treat it as Personally Identifiable Information. When this information does not identify you personally, we treat it as Non-personally Identifiable Information.

Cookies

When you visit our Sites, ENTITY and our partners, affiliates, or analytics or service providers may also use technologies such as cookies, beacons, tags and scripts to assess how you interact with our Sites. These technologies are used in analyzing trends, administering the Sites, tracking users’ movements around the Sites and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.

To help facilitate the delivery of relevant content, we use Google Analytics. Google Analytics uses cookies to report on user interactions on our and others’ websites. We use the data collected for optimizing marketing, refining advertising and/or programming strategies and generally making advertising more effective. Note that Google’s opt-out mechanism is specific to Google activities and does not affect the activities of other ad networks or analytics providers that we may use.

We may also use cookies for authentication. Users can control the use of cookies at the individual browser level. If you reject cookies, you may still use our Sites, but your ability to use some features or areas of our Sites may be limited.

Behavioral Advertising/Re-Targeting

ENTITY takes no responsibility for the content or privacy practices of external sites. Other websites that we may link to are owned and operated by third parties, and ENTITY has no control over them. The fact that we include links to other websites does not mean that ENTITY approves of or endorses any other third party website or the
content of that website. We accept no liability for any statements, information, products, or services that are published on or are accessible through any websites owned or operated by third parties. We encourage you to carefully read the privacy policy of any website you visit.

In particular, we partner with a third party to either display advertising on our Sites or to manage our advertising on other sites. Our third party partner may use technologies such as cookies to gather information about your activities on these Sites and other sites in order to provide you advertising based upon your browsing activities and interests. PLEASE NOTE THAT THIS PRIVACY POLICY DOES NOT COVER THE COLLECTION AND USE OF INFORMATION BY SUCH ADVERTISING COMPANIES.

Social Media Features

Our Sites may include social media features, such as the Facebook Like Button and other tools that allow you to share content through various social media networks. These features may collect your IP address, which page you are visiting on our Sites, and may set a cookie to enable the feature to function properly. These social media
features and tools are either hosted by a third party or hosted directly on our Sites. Your interactions with these features are governed by the privacy policy of the company providing it.

Public Posting Areas

Please note that any information you include in a message you post to any chat room, forum or other public posting area is available to anyone. If you do not want people to know your email address, for example, do not include it in any message you post publicly. PLEASE BE EXTREMELY CAREFUL WHEN DISCLOSING ANY
INFORMATION IN CHAT ROOMS, FORUMS AND OTHER PUBLIC POSTING AREAS. WE ARE NOT RESPONSIBLE FOR THE USE BY OTHERS OF THE INFORMATION THAT YOU DISCLOSE IN CHAT ROOMS, FORUMS AND OTHER
PUBLIC POSTING AREAS.

Donations

If you made a donation to ENTITY, we will use your information to send donation receipts, communicate with you about our mission and ask for donations. ENTITY also rents and exchanges donor information with other organization, this includes name, address and phone number. It does not include specific donation amounts or dates. By renting and exchanging donor information, both organizations are able to find new donors who support their mission.

Security

We follow generally accepted standards to protect the Personally Identifiable Information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.

Once we receive your transmission, we make commercially reasonable efforts to ensure security on our systems. If we learn of a security systems breach, we may attempt to notify you electronically so that you can take appropriate protective steps. By using the Sites or providing Personally Identifiable Information to us, you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of the Sites. We may post a notice on our Sites if a security breach occurs. We may also send an email to you at the email address you have provided to us in these circumstances. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

Updating Your Information

If your information changes, or if you no longer desire our service, you may correct, update, amend or delete it by emailing us at EGAprivacy@gmail.com. We will respond to your request to access within 30 days.

We will retain your information for as long as needed to provide you services and to comply with our accounting and legal obligations, resolve disputes, and enforce our agreements.

Email Communication and Opting Out

We may send you communications or data regarding the Sites, including but not limited to (i) notices about use of the Sites, including any notices concerning violations of use, and (ii) our newsletter, updates or announcements about our Sites, or this Privacy Policy. By providing us with your email address, you agree to receive this type of communication from us. These notices will be sent to the email address we have on file
for you.

Out of respect for your privacy, you may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails, or you can contact us at EGAprivacy@gmail.com. You can also request that your email address not be shared as part of any list exchanges by emailing us at EGAprivacy@gmail.com. Please note that you may continue to receive communications from ENTITY while we process your opt-out request. Additionally, if your information has already been shared with a third-party, you may need to contact them directly to opt-out of their communications.

Assignment

We may share your Personally Identifiable Information collected via the Sites in the course of any direct or indirect reorganization process including, but not limited to, mergers, acquisitions, divestitures, bankruptcies, and sales of all or a part of our assets.

How We Respond to Do Not Track Disclosures

The “Do Not Track” (“DNT”) privacy preference is an option that may be made in some web browsers allowing you to opt-out of tracking by websites and online services. At this time, global standard DNT technology is not yet finalized and not all browsers support DNT. We therefore do not recognize DNT signals and do not respond to them.

Choice of Law

This Privacy Policy has been made in, and shall be governed, construed and enforced in accordance with the laws of Louisiana, without giving effect to any conflict of law principles.

Disputes and Agreement to Arbitrate

By using the Sites, you and ENTITY agree that, if there is any controversy, claim, action, or dispute arising out of or related to your use of the Sites, or the breach, enforcement, interpretation, or validity of this Privacy Policy or any part of it (“Dispute”), both parties shall first try in good faith to settle such Dispute by providing written notice
to the other party describing the facts and circumstances of the Dispute and allowing the receiving party 30 days in which to respond to or settle the Dispute.

Notice shall be sent:

1) to Entity at P.O. Box 160, Lawtell, LA 70550, or
2) to you at the contact information on file with ENTITY.

Both you and ENTITY agree that this dispute resolution procedure is a condition precedent that must be satisfied before initiating any litigation or filing any claim against the other party. IF ANY DISPUTE CANNOT BE RESOLVED BY THE ABOVE DISPUTE RESOLUTION PROCEDURE, YOU AGREE THAT THE SOLE AND EXCLUSIVE JURISDICTION FOR SUCH DISPUTE WILL BE DECIDED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS. ARBITRATION ON AN INDIVIDUAL BASIS MEANS THAT YOU WILL NOT HAVE, AND YOU WAIVE, THE RIGHT FOR A
JUDGE OR JURY TO DECIDE YOUR CLAIMS, AND THAT YOU MAY NOT PROCEED IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE CAPACITY. Other rights that you and we would have in court will not be available or will be more limited in arbitration, including discovery and appeal rights. All such Disputes shall be exclusively
submitted to JAMS (www.jamsadr.com) for binding arbitration under its rules then in effect, and will occur in Louisiana, before one arbitrator to be mutually agreed upon by both parties.

The arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve any dispute arising under or relating to the interpretation, applicability, enforceability, or formation of this Privacy Policy, including any claim that all or any part of this Privacy Policy is void or voidable.

Changes to this Policy

We may update this Privacy Policy to reflect changes to our information practices. If we make any material changes we will notify you by email (sent to the email address specified in your account) or by means of a notice on our Sites prior to the change becoming effective. For all changes, including minor changes, we will update the “Last Updated” date at the top of this Privacy Policy. We encourage you to periodically review this page for the latest information on our privacy practices.
